In no event shall our total liability to you exceed the amount you paid to us in the past twelve (12) months.

You agree to defend, indemnify, and hold harmless MusicToGo and its team from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from your use of the site, your violation of these Terms, or your violation of any third-party right, including copyright or privacy rights.

9. Dispute Resolution and Mandatory Arbitration

Let’s talk it out first! If you have an issue, please contact us. If we can’t resolve it informally, you and MusicToGo agree to resolve any claims related to these Terms through final and binding arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
